(a)
No person shall purchase, offer for sale, or use any vaporized form of alcohol produced by an alcohol vaporizing device.
(b)
For purposes of this section, “alcohol vaporizing device” means any device, machine, or process that mixes spirits, liquor, or other alcohol product with pure oxygen or other gas to produce a vaporized product for the purpose of consumption by inhalation.
(c)
(1)
Any person who sells or offers for sale any vaporized form of alcohol produced by an alcohol vaporizing device is guilty of a misdemeanor that shall be punishable by a fine of not more than one thousand dollars ($1,000) or by imprisonment in the county jail for not more than six months, or by both.
(2)
Any person who purchases or uses any vaporized form of alcohol produced by an alcohol vaporizing device is subject to a fine of two hundred fifty dollars ($250).
(d)
Any person who possesses, sells, or offers for sale any alcohol vaporizing device shall be guilty of a misdemeanor.
