PERB’s Office of General Counsel (OGC) issued warning letters in the cases, finding that neither stated a prima facie violation of the duty of fair representation and CTA did not owe Reilly such a duty. Reilly filed amended charges in both cases; OGC dismissed the charges, finding that they did not correct the issues identified in the warning letters. Reilly appealed.
